QuarkTerms of Service

These Terms of Service (“Terms”) govern your use of the Quark mobile app and the Quark Creator Studio at quarkstep.com (together, “Quark”), operated by Quark Learning, Inc. (“we,” “us”). By creating an account or using Quark, you agree to these Terms and to our Privacy Policy.
1. Who Can Use Quark
You must be at least 13 years old to use Quark. If you are under the age of majority where you live, you may use Quark only with the consent of a parent or guardian. You are responsible for keeping your account credentials secure and for all activity under your account. Provide accurate account information and create only one account per person.
2. Your Content (Creators)
Educators using Creator Studio keep ownership of the courses, lessons, exercises, and media they create (“Creator Content”). By publishing Creator Content on Quark, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute it for the purpose of operating Quark — including continuing to serve published course versions to learners who enrolled in them. You are responsible for your Creator Content: you confirm you have the rights to publish it and that it does not infringe anyone else’s rights, mislead learners, or violate the acceptable-use rules below.
3. Learner Progress
Your learning progress (XP, streaks, mastery) is personal to your account. It has no monetary value, cannot be transferred or exchanged, and may be recalculated if we fix bugs or improve how mastery is measured.
4. Acceptable Use
You agree not to:
- upload content that is unlawful, harmful, hateful, sexually explicit, or infringes intellectual property rights;
- attempt to access other users’ accounts or data, or probe, disable, or disrupt the service;
- use automated tools to scrape content or artificially inflate progress, streaks, or analytics;
- misrepresent your identity or affiliation, or file knowingly false content reports.
We may remove content and suspend or terminate accounts that violate these rules. Learners can report problematic content in-app; reports are reviewed by our moderation team.
5. Quark’s Content and License to You
Quark, including its software, design, and built-in content, is owned by us or our licensors. We grant you a personal, non-exclusive, non-transferable, revocable license to use the app and Creator Studio for their intended purposes. You may not copy, modify, reverse-engineer, or resell Quark except where the law permits it regardless of these Terms.
6. Account Deletion and Termination
You can delete your account at any time from inside the app or Creator Studio; deletion behavior — including what happens to published courses with enrolled learners — is described in the Privacy Policy. We may suspend or terminate accounts that violate these Terms, and we may discontinue or change Quark with reasonable notice where practicable.
7. Disclaimers
Quark is provided “as is” and “as available.” We do not warrant that the service will be uninterrupted or error-free, or that any course content is accurate or fit for a particular educational purpose — Creator Content is the responsibility of the educator who published it.
8. Limitation of Liability
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of Quark. Our total liability for any claim relating to Quark is limited to the greater of $50 or the amount you paid us in the 12 months before the claim. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
9. Changes to These Terms
We may update these Terms; we’ll update the “Last updated” date above and notify you in-app of material changes. Continuing to use Quark after changes take effect means you accept the updated Terms.
10. Governing Law
These Terms are governed by the laws of the jurisdiction where Quark Learning, Inc. is established, without regard to conflict-of-law rules.
